Election Commission recommended to the BJP Varun Gandhi shoul not be allowed to contest as a candidate for the Lok Sabha elections after holding him guilty of violating Model Code of Conduct for his hate speeches against Muslims.
Commission in a 10-page order said Gandhi's controversial speeches in Pilibhit(UP) early this month contained "highly derogatory" references and seriously provocative language of a "wholly unacceptable" nature against a certain community.Censuring the grandson of Indira Gandhi for outraging the religious feeling of a particular community, the Commission observed that he does not deserve to be a candidate in the coming general elections.Commission said it is conscious of its limitations under the law that it cannot debar him from contesting elections unless he is convicted or held guilty by courts and therefore expected the BJP to "deny" Gandhi a party nomination for the coming elections.The EC's order is unprecedented because never before a party been told by it not to field any person as a candidate because the law does not give it the authority to disqualify a candidate, a fact admitted in its order on Sunday.

The district administration has taken several security measures and additional police forces have been deployed for strict enforcement of Section 144 CrPC during Gandhi's Pilibhit visit. Administration has not allowed any gathering at entry point of the Pilibhit and large numbers of police personnel are deployed there. Security forces have conducted flag march in the town.The Election Commission had already transferred the DM and the SP of Pilibhit besides suspending the ADM and the ASP. It had also sent notices to Varun and UP BJP President Ramapati Ram Tripathi to explain their views on the hate speeches.

When asked whether Varun, who is to contest from Pilhibit in Uttar Pradesh would be allowed to do so, Gopalaswamy said "at the moment the question does not arise, we will look into it when nomination starts."To a query whether action would be taken against the BJP, the CEC said the Commission would decide on it after the party filed its reply to the notice.

"The party's central leadership will come out with an official response on the issue only after the meeting of its office-bearers tomorrow," BJP spokesperson Rajiv Pratap Rudy said last night.

BJP Legislature party last night met Orissa Governor M C Bhandare and intimated him its decision to pull out from the government.The party also demanded President’s rule in the state stating that the government had reduced to minority after their withdrawal.The BJD-BJP combination has 61 and 32 MLA respectively in the 147 member Orissa Assembly.However, BJD govt appeared safe as it was close to mustering the support of 14 more MLAs from JMM (4), CPI (1), CPI-M (1) and eight independents necessary to reach the majority mark of 74 in the 147-member state assembly.Coming out of the Raj Bhawan BJP Legislature party leader Biswa Bhusan Harichandan told the waiting newsmen that the Governor had a patient hearings and assured the BJP delegation that he would take appropriate steps in the right time.The BJP Leader said the people of Orissa have voted for the alliance in the last Assembly elections and not for Naveen Patnaik or the Biju Janata Dal.
He said Chief Minister Naveen Patnaik has closed the chapter of long eleven years of alliance by unilaterally declaring to contest the Assembly and Lok Sabha elections in the state separately.Naveen Patnaik-led BJD last night said it was not averse to join the third front, being cobbled up by left parties and others.”We are not averse to join the third front. Sensex gains to support IT sector at lower levels

2009-03-06 13:40:19 - Sensex recovered by 49 points after a weak opening on emergence of buying by funds in fundamentally strong stocks.

Bombay Stock Exchange barometer, which had lost over 150 points at the outset, was trading higher by 49 points at 8,246.92 at 1200 hrs with most of the banking and capital goods shares posting smart gains.

Sensex, after making forty month bottom in the yesterday day trading, was in flux with safe and selected buying by investors and institutions led इन IT sector shares market gained support lower levels before ending with a gain of 127.90 points to 8,325.82 and Nifty of the NSE rose by 43.45 points to 2,620.15. Bombay Stock Exchange benchmark Sensex on Friday closed nearly 128 points higher on funds buying blue-chips led by software exporters.Meanwhile, wide-based National Stock Exchange's index, Nifty, rose by 15.10 points to 2,591.80.


Analyst said the market turned green as investors purchased fundamentally strong shares available at attractive low levels. Sustained heavy selling in last two trading sessions pulled down the market to a 40-month low level.IT sector index gained the most by rising 3.05 per cent to 2,072.32, led by a steep rise in Infosys, a heaviest on the index.Infosys, the second-largest software exporter, gained 3.08 per cent to Rs 1,219.20 as the rupee headed for its third weekly drop.

Tata Consultancy Services, the largest, added 3.84 per cent to Rs 480.80, and Wipro, the third-biggest, by 3.37 per cent to Rs 213.20.Over 50 per cent revenue of the Indian software companies comes from the US markets.

Election Commissioner Mr Navin Chawla to take over as the next Chief Election Commissioner on 20th April, due to his seniroity and thereby succeeding Mr N Gopalaswami who retires on that day.President Mrs Pratibha Devisingh Patil has approved the name of Mr Chawla for the post. Mr Chawla, an IAS officer of the 1969 batch, will hold charge till 29th
of July, 2010 when he will attain the age of 65 years.With the name of his appointment the NDA-BJP has raised their displeasure for his intend to freeze the BJP symbol in geight of CD controversy:

The elevation of Mr Chawla comes after a controversy triggered by Mr Gopalaswami's recommendation to the President for his removal from office for alleged partisan functioning.

Mr Chawla has been elevated to CEC's post on the advice of the government which had rejected Mr Gopalaswami's plea for his removal, saying there was no merit in the allegations against the Election Commissioner. Mr Chawla in continuance as Election Commissioner has been challenged in the Supreme Court. Supreme court bench headed by Chief Justice K G Balakrishnan has decided to hear petition seeking a direction for implementation of recommendations of Chief Election Commissioner N Gopalaswamy for his removal and the petition filed by the United Communist Party of India, on the 20th March 2009.

The appointment of Mr Navin Chawla as the next Chief Election Commissioner, has been descibed by the BJP as unfortunate. BJP leader Mr. Arun Jaitely alleged that political parties have questioned Mr. Chawla's impartiality to hold a Constitutional post.

Lok Sabha polls in five phases

The constitution of the 15th Lok Sabha is in process with EC annoucing the schedule the poll panel said a total of 714 million electorate will cast their votes on 16th 23rd, 30th April and 7th and 13th May to elect the 543-member House.Counting of votes will take place on 16th May, Chief Election Commissioner N Gopalaswami, flanked by Election Commissioners Navin Chawla and S Y Quraishi, announced at a press conference at New Delhi on Monday.

Uttar Pradesh, which has the maximum of 80 seats, and Jammu and Kashmir will have five-phase polls while Bihar will go to polls in four stages.Maharashtra and West Bengal will have three phased polls, while Andhra Pradesh, Assam, Jharkhand, Karnataka, Madhya Pradesh, Manipur, Orissa and Punjab will have voting in two stages.
The remaining 15 states and seven union territories will have one-day poll, he said.
Assembly elections to Andhra Pradesh, Orissa and Sikkim will also be held along with the Lok Sabha polls.The elections will be held for the first time in the redrawn constituencies.
Fifteenth Lok Sabha is required to be constituted before the 2nd June 2009.

The following is the polling schedule for states announced by Chief Election Commissioner N Gopalaswami on Monday.
Phase 1
16th April- Andhra Pradesh, Arunachal Pradesh, Assam, Bihar, Jammu and Kashmir, Kerala, Maharashtra, Manipur, Meghalaya, Mizoram, Nagaland, Orissa, Uttar Pradesh, Chhattisgarh, Jharkhand, Andaman and Nicobar Island, Lakshadweep.
Phase 2
23rd April- Andhra Pradesh, Assam, Bihar, Goa, Jammu and Kashmir, Karnataka, Madhya Pradesh, Maharashtra, Manipur, Orissa, Tripura, Uttar Pradesh and Jharkhand.
Phase 3
30th April- Bihar, Gujarat, Jammu and Kashmir, Karnataka, Madhya Pradesh, Maharashtra, Sikkim, Uttar Pradesh, West Bengal, Dadar and Nagar Haveli and Daman and Diu.
Phase 4
7th May- Bihar, Haryana, Jammu and Kashmir, Punjab, Rajasthan, Uttar Pradesh, West Bengal and Delhi.

11 ‘General’ Lok Sabha seats become ‘Reserved’The category of as many as 11 Lok Sabha constituencies have undergone change from General to Reserve in the coming parliamentary elections following redrawing of seats.
Of the 543 total seats, 84 have been reserved for Scheduled Castes — an increase of five seats over 2004 elections, Chief Election Commissioner N Gopalawami said at a press conference at new Delhi on Monday.
Similarly, 47 constituencies have been earmarked for Scheduled Tribes category — an increase of six seats, he said.
Model code of conduct has come into force with immediate effect, the CEC said.

The upcoming polls will also witness for the first time use of photo electoral rolls in 522 out of the 543 constituencies.At least 71.4 crore voters will be eligible to elect the next Lok Sabha, an increase of 4.3 crore over the last general elections in 2004.A massive deployment of 40 lakh civil personnel and 21 lakh police personnel will be made for the smooth conduct of elections.
